The Gallery Real Estate Agency Pty Limited (ABN 99 643 017 074), Corporation Licence 10103433 (we, us, our) is committed to complying with its obligations under the Privacy Act 1988 (Cth) (the Act).
The Act allows personal information to be collected, used and disclosed for the purposes for which it was collected in accordance with the Act.
This Website Privacy Policy applies only to the extent we collect, use and disclose personal information in connection with our website at thegalleryrealestate.com.au.
We also have a separate Privacy Policy and Collection Notice that deals with how we handle personal information in connection with our residential property management business. We will provide a copy when we first collect personal information from you, and it is available at any time on request.
This Website Privacy Policy may be revised, updated or replaced from time to time. Any changes take effect on the date the revised version is posted to our website.
What information do we collect?
When you visit our website, we may collect the following information:
- Information you submit through an online form, such as your name, email address, phone number, property address and any message or enquiry you provide (for example, when requesting a rental appraisal, a management proposal, or general enquiry).
- Information you provide when you register interest in a property we manage, including the information collected through any rental enquiry or inspection registration form.
- Information collected automatically when you visit our website, including your IP address, browser type and version, operating system, the pages you visit, the date and time of your visit, the referring website, and information collected through cookies and analytics tools (including Google Analytics or similar).
- Any other information you choose to provide to us through the website (for example, in an email sent through a contact link on the site).
Why do we collect this information?
We collect, use and disclose information collected through our website for the following purposes:
- To respond to enquiries about our residential property management services, including rental appraisals, management proposals, leasing enquiries and tenant enquiries about properties we manage.
- To process and respond to applications to inspect or apply for a rental property we manage.
- To provide you with information about our services that you have requested, or that we reasonably believe may be of interest to you (subject to your right to opt out at any time).
- To administer and improve our website, monitor its performance and security, and analyse how visitors use the site.
- To comply with our legal obligations, including under the Privacy Act and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
Automated Decision Making (ADM)
We do not currently use Automated Decision Making (ADM) on our website to make, or do anything substantially and directly related to making, a decision that could reasonably be expected to significantly affect your rights or interests.
If we begin to use ADM in a way that triggers obligations under the Act, we will update this Website Privacy Policy to disclose the types of personal information used and the kinds of decisions made.
Information disclosed
We will use and disclose personal information only for the purposes for which it is collected in accordance with the Act, including:
- Providing services and customer support, including service updates.
- Maintaining and updating our records.
- Comparing information for accuracy, and verifying it with third parties (for example, with referees provided in a rental enquiry or proposal request).
- Providing information as authorised or required by law or a relevant government body or authority.
- Sharing information with our IT and service providers (including our website host, CRM, email and analytics providers) to the extent reasonably necessary for them to provide their services to us.
Overseas disclosure
We may disclose personal information collected through our website overseas in the following circumstances. We use cloud-based website hosting, analytics and customer relationship management (CRM) services. The servers used by these providers may be located outside Australia. As electronic or networked storage can be accessed from various countries through an internet connection, it is not always practical to know in which country information about an individual may be held.
To the extent we can identify the countries to which information may be transferred or from which it may be accessed, they are:
- Australia (the primary location of our PropertyMe, Microsoft 365 and CRM data).
- The United States of America (in connection with website hosting, analytics tools, Microsoft 365 and LastPass).
- Other countries from which our service providers may operate from time to time for support, hosting or engineering purposes.
Some countries to which information may be transferred may not have laws or binding schemes that overall protect personal information in a way that is substantially similar to the Australian Privacy Principles, and there may not be any mechanism or binding scheme that you can access to enforce legal protections.
Anonymity and pseudonyms
General users of the website do not need to disclose their identity to us in order to browse it. This website does not collect personal information about people who generally access it, except in the circumstances described above.
Please note that we may not be able to provide some or all of our services if you choose to remain anonymous or to use a pseudonym (for example, we cannot process a rental application or property appraisal request anonymously).
Cookies and analytics

Marketing and opt-out
We may use the information you provide through the website (excluding sensitive information) for marketing and research purposes, to analyse and improve our services, and to inform you about services, market updates or other communications we consider may be of value or interest to you, unless you tell us not to.

Where we collect, use or disclose your personal information through this website, you have the right to request access to any personal information we hold about you, unless we are permitted to withhold that information. We may charge a reasonable fee where access is provided.
